Chapter 1 General Provisions
Article 1 (Purpose)
These Terms and Conditions govern the terms and procedures for use of all services (hereinafter referred to as "Services") provided by Myungsung Co., Ltd. (hereinafter referred to as the "Company") on its website (http://hi-myungsung.com).
Article 2 (Definitions)
The terms used in these Terms and Conditions are defined as follows:
1. User: A person who receives services provided by the Company in accordance with these Terms and Conditions.
2. Service Agreement: A contract concluded between the Company and the User regarding the use of the Service.
3. Registration: An act of completing a Service Agreement by filling out the relevant information in the application form provided by the Company and agreeing to these Terms and Conditions.
4. Member: A person who has registered as a member by providing the personal information required for membership on this site.
5. User Number (ID): A combination of English letters and numbers selected by the User and approved by the Company for member identification and use of the Service.
6. Password: A combination of English letters, numbers, and special characters set by the user to protect the member's information.
7. Termination: A declaration of intent by the company or member to terminate the service agreement after using the service.
Article 3 (Validity and Changes to Terms and Conditions)
If a member disagrees with the revised terms and conditions, they may request withdrawal (cancellation) of their membership. If they continue to use the service without expressing objection after seven days from the effective date of the revised terms and conditions, they will be deemed to have agreed to the changes.
1. These Terms and Conditions become effective upon posting on the service screen, notice board, or other means.
2. The Company may change the contents of these Terms and Conditions if it deems necessary. Any changes will be posted on the service screen.
If you continue to use the Service without expressing your objection after 7 days of the notice, you will be deemed to have agreed to the changes.
3. If a user does not agree to the revised terms and conditions, they may discontinue use of the service and cancel their membership.
Continued use will be deemed acceptance of the revised terms and conditions, and the revised terms and conditions will take effect in the same manner as the preceding paragraph.
Article 4 (Applicable Provisions)
Matters not specified in these Terms and Conditions shall be governed by the provisions of the Framework Act on Telecommunications, the Telecommunications Business Act, and other relevant laws and regulations.
Chapter 2 Service Use Agreement
Article 5 (Establishment of User Agreement)
The User Agreement is established upon the Company's approval of the User's application for use and the User's agreement to the Terms and Conditions.
Article 6 (Application for Use)
Users can apply for use by filling out the application form requested by the company on the service's member information screen, including their personal information.
Article 7 (Approval of Application for Use)
1. If a member has accurately filled out all the information in the application form and submitted it, the application for use will be approved unless there are special circumstances.
2. Approval may not be granted in the following cases:
A. When the application was not submitted under the member's real name.
B. When the application was submitted under someone else's name.
C. If the application contains false information.
D. If the application is submitted with the intent to disrupt public order or morals.
E. If the application fails to meet any other application requirements set by the company.
Article 8 (Changes to Contractual Terms)
Members must update any changes to the information provided during the application process. Members are responsible for any issues arising from failure to update their information.
Chapter 3 Obligations of Contracting Parties
Article 9 (Company Obligations)
The Company will not disclose or distribute personal information of members known in connection with the provision of services to third parties without the member's consent. However, this does not apply in cases where there is a request from a government agency pursuant to the provisions of the Framework Act on Telecommunications and other laws, for criminal investigation purposes, or in cases where there is a request pursuant to procedures stipulated in other relevant laws and regulations.
Article 10 (Member Obligations)
1. Members must not engage in any of the following acts when using the Service:
A. Unauthorized use of another member's ID
B. Reproducing, publishing, or providing information obtained from the Service to a third party
C. Infringing upon the Company's copyrights, the copyrights of third parties, or other rights
D. Distributing content that violates public order and morals E. 범죄와 결부된다고 객관적으로 판단되는 행위
F. Other Violations of Relevant Laws
2. Members may not use the Service for commercial purposes, and the Company shall not be liable for any consequences arising from the use of the Service for commercial purposes.
3. Members may not transfer or gift their right to use the Service or any other contractual status to others, nor may they provide such rights as collateral.
Chapter 4 Service Use
Article 11 (Member Obligations)
1. Members are responsible for maintaining their email, bulletin board, and registered information, as needed.
2. Members may not arbitrarily delete or modify any information provided by the Company.
3. Members must not post content on the Company's website that violates public order and morals, or that infringes on the copyrights or other rights of third parties. Members are solely responsible for any consequences arising from the posting of such content.
Article 12 (Post Management and Deletion)
To ensure efficient service operation, member memory space, message size, and retention periods may be limited. Posted content may be deleted without prior notice if it falls under any of the following categories:
1. If the content defames or slanders another member or a third party and damages their reputation.
2. If the content violates public order and morals.
3. If the content is deemed to be related to criminal activity.
4. If the content infringes upon the company's copyright, the copyrights of a third party, or other rights.
5. If a member posts obscene material on the company's website or bulletin board or links to obscene websites.
6. If the content is deemed to violate other relevant laws.
Article 13 (Copyright of Posts)
The copyright of posts belongs to the poster. Members may not use materials posted on the Service for commercial purposes, including processing or selling information obtained through the Service.
Article 14 (Service Availability)
The Service is available 24 hours a day, 365 days a year, unless there are special operational or technical circumstances. However, this does not apply in the event of regular maintenance or other unforeseen circumstances.
Article 15 (Responsibility for Service Use)
Users are prohibited from using the Service to engage in any activities, including hacking, linking to pornographic websites, or illegally distributing commercial software. The Company is not responsible for any business consequences, losses, or legal action taken by relevant authorities resulting from violations of these Terms.
Article 16 (Suspension of Service Provision)
Service provision may be suspended in the following cases:
1. In unavoidable circumstances, such as due to maintenance or other construction work on service facilities.
2. In cases where a fixed-line telecommunications service provider, as defined by the Telecommunications Business Act, suspends telecommunications services.
3. In cases where system maintenance is required.
4. In cases of other force majeure.
Chapter 5 Contract Termination and Restrictions on Use
Article 17 (Contract Termination and Restrictions on Use)
1. If a member wishes to terminate the service agreement, the member must submit a request for termination online.
The company will take action after verifying the member's identity.
2. If a member engages in any of the following acts, the company must notify the member of its intention to terminate the service agreement at least 30 days prior to termination,
and provide the member with an opportunity to express their opinion.
A. If you steal someone else's user ID and password.
B. If you intentionally interfere with service operation.
C. If you apply for membership under false pretenses.
D. If the same user registers twice with different IDs.
E. If you distribute content that violates public order and morals.
F. If you engage in any act that damages the reputation or causes disadvantage to others.
G. If you transmit a large amount of information or advertising information for the purpose of disrupting the stable operation of the service.
H. If you distribute computer virus programs that cause information and communication equipment to malfunction or destroy information.
I. If you infringe on the intellectual property rights of the company, other members, or third parties.
J. If you use another person's personal information, user ID, or password illegally.
K. If a member posts obscene material on their website or bulletin board or links to obscene websites.
L. If any other relevant laws or regulations are deemed to be violated.
Chapter 6 Miscellaneous
Article 18 (Prohibition of Transfer)
Members may not transfer or donate their service usage rights or other contractual status to others, nor may they provide them as collateral.
Article 19 (Compensation for Damages)
The Company shall not be liable for any damages suffered by members in connection with services provided free of charge, except where such damages are caused by the Company's intent or gross negligence.
Article 20 (Exemption from Liability)
1. The Company shall be exempt from liability for service provision if it is unable to provide the Service due to natural disasters, war, or other similar force majeure.
2. The Company shall be exempt from liability for damages resulting from unavoidable circumstances, such as maintenance, replacement, regular inspections, or construction of service equipment.
3. The company is not responsible for any service disruption caused by the member's fault.
4. The Company is not responsible for any losses incurred by members due to anticipated benefits or information obtained through the Service.
5. The Company is not responsible for the reliability, accuracy, or other aspects of information, materials, or facts posted by members on the Service.
Article 21 (Court of Jurisdiction)
In the event of a lawsuit arising from the use of the Service, the court with jurisdiction over the Company's location shall have exclusive jurisdiction.
Supplementary Provisions
(Effective Date) These Terms and Conditions shall take effect on December 13, 2023.
